This website is owned by Fundació Privada Centre d’Higiene Mental Orienta (hereinafter, “Fundació Orienta”) with a registered office at Carrer Cardenal Vidal I Barraquer, 28, 08830 Sant Boi de Llobregat and holder of Cif number g-61522017 and registered in the Register of Private Foundations of the Generalitat de Catalunya under number 1168, (hereinafter, “Fundació Orienta”).

The Orienta Foundation aims to make your shopping experience as easy, fast, and fair as possible, and to ensure that you get the services or products you want as quickly as possible.

2. Purpose and scope of application of the General Conditions of Purchase

These General Conditions of Purchase aim to ensure that the purchase process at the Orienta Foundation is satisfactory and understandable. Through this website, the Orienta Foundation provides you with an online purchasing service to be able to purchase magazines or books published by the Foundation from wherever you are, as well as to be able to register for courses, conferences, and other training activities organised by the Foundation.

By accessing this website, you become a User. These General Conditions of Purchase constitute, together with the Privacy Policy, the Cookies Policy, and the Conditions of Use of the website, the set of rules that regulate the use of this website, as well as the relationship between the Foundation and the Users.

The set of legal texts published on this website has been drafted under the applicable regulations on the Internet, consumers and users, electronic commerce, and data protection, among others, the Law 34/2002, of Services of the Information Society and Electronic Commerce (“LSSI”), the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, and other complementary laws; Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals concerning the processing of personal data and the free movement of such data; Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights (LOPD).

3.  Access to the online catalogue

On this website, the Orienta Foundation offers you the possibility to buy magazines or books published by our Foundation and also to register for courses, conferences, and other training activities organised by the Foundation.

By accessing the purchase process you declare that you are of legal age and have the necessary legal capacity to fully understand and accept these General Conditions of Purchase.

The User may browse the website freely and access it as many times as he/she wishes, without the need to register.

4. Conditions of use of the online shopping cart

As a User, you undertake to use the website in accordance with these General Conditions of Purchase, good faith, and current legislation. Likewise, you declare and guarantee that you are of legal age and understand these General Conditions of Purchase.

In this respect, the Orienta Foundation reserves the right to verify the truthfulness of the data provided by the Users, especially their age. The Orienta Foundation will not assume any responsibility for persons who do not comply with these General Conditions of Purchase, the applicable regulations in force.

Likewise, any fraudulent, abusive, illicit, or contrary to good faith use of the website by the User is expressly prohibited.

5. Conditions of online cart purchase

Purchasing on the Orienta Foundation website is very simple and does not even require registration.

To buy any of the products or training, the User has to access the “publications” or “classroom” tabs and select what he/she wants to buy. Once they have selected all the items they want, the User must access the list that appears on the screen and fill in the requested data in order to process their order.

When filling in the requested information in the purchase process available on the website, those fields which must be filled in will be marked with an asterisk so that the User can clearly identify them. Likewise, those data whose completion has been detected as defective, incorrect, or incomplete on the website and which are necessary to complete the process in question will be requested again so that the User can review them, correct them and enter them correctly.

As a User, you are solely responsible for providing your data correctly in the online purchase process on the website. Therefore, the Orienta Foundation reminds you that you will have to pay special attention and care when entering your personal data, especially bank and order delivery data.

The Orienta Foundation reserves the right to review, withhold, temporarily suspend or definitively cancel unilaterally, without prior notice, and without the right to any compensation, any purchase from the online shop in which it detects signs of fraudulent or illicit use or uses contrary to these General Conditions of Purchase, the law or good faith on the part of the corresponding User.

6. Promotions or contests

The Orienta Foundation may organise or promote through its website various promotions and competitions, if necessary.

The Orienta Foundation will regulate or publish in each case the conditions of participation in the promotions or contests that it organises or participates in. In any case, the Orienta Foundation reserves the right to modify the conditions of any promotion or contest it organises, as well as to revise, withhold the prize(s), temporarily suspend or definitively cancel unilaterally, without prior notice, and without the right to compensation.

7. Availability of products

At the Orienta Foundation, we make every effort to ensure that all the products we offer in our online shop are available to Users at all times, but we cannot guarantee that all our products are always available. For this reason, certain products may be temporarily unavailable or out of stock. Therefore, orders and purchases made by Users in our online shop through the website are always subject to the availability of the products.

If a product is not available in the online shop, the Orienta Foundation will duly indicate this so that Users are informed of the temporary impossibility of acquiring the product in question. If for any reason any product is not available once the online purchase has been made by a User, the Orienta Foundation will contact the User as soon as possible by e-mail or telephone to inform him/her of this situation so that the User can choose between cancelling his/her purchase, keeping the purchase without the product in question or choosing a different product.

The Orienta Foundation is not responsible for those pieces of training that are not directly organised by us.

8. Prices

The price reflected for each product on the website corresponds to the price in force at the time the User accesses it and includes taxes and shipping costs. VAT will be applied according to the corresponding rate in accordance with current legislation. Likewise, the User will bear the shipping costs. In this case, the Orienta Foundation will always specify the shipping costs before any payment being made by the User. The Orienta Foundation reserves the right to change at any time, without prior notice and unilaterally, the prices of the products offered on the Website, although this modification will not affect the orders previously placed by the User for which the Orienta Foundation has already sent the corresponding “Order Confirmation” to the User.

The Orienta Foundation will not be obliged to supply any product at an incorrect lower price (until after the “Confirmation of Purchase”) if the error in the price is obvious, evident, or unequivocal or constitutes an obstructive error and could have been reasonably recognised by the User.

9. Forms of payment

The Orienta Foundation offers Users the possibility of paying for purchases in the online shop using Visa, MasterCard, or the PayPal payment system. The User simply has to enter the requested bank details. For security reasons, in no case will the Orienta Foundation store or process the payment details provided after the purchase has been made in our online shop. The Orienta Foundation will charge the amount of the purchase made to our online shop as soon as this process is completed.

10. Shipping
The Orienta Foundation reminds Users that it offers the products available through the website for delivery worldwide. Once the order is confirmed, the User can choose within a maximum period of thirty (30) days the delivery address to which Orienta Foundation will send the shipment. The Orienta Foundation does not guarantee the completion of the delivery periods mentioned above in the event of force majeure, actions, or omissions of third parties or if the delivery address indicated by the User in the purchase process is incomplete, inaccurate, or incorrect. The delivery to the Users of the products purchased on the website is made through collaborating companies or providers of mailing or transport services contracted by the Orienta Foundation. If the User is absent at the moment of the shipment delivery at the address the User had indicated, the carrier will leave a notice indicating how to proceed to arrange a new delivery within five (5) days after the first delivery attempt. If after fifteen (15) calendar days from the first date of the notice, the User does not contact the carrier to arrange a new delivery date, the order will be returned to the Orienta Foundation and the User will have to pay the shipping and return costs.

11. Right of withdrawal of the user

The right of withdrawal is the faculty that the User has as a consumer to withdraw from the contract assumed with the Orienta Foundation to purchase any product from our online shop without the need to provide any justification, nor to pay any penalty except for the costs expressly foreseen in the present General Conditions of Purchase. The User may cancel the contracting of activities or services carried out on the website within a maximum period of 14 calendar days from the day on which the User or a third party indicated by the User, other than the carrier contracted by the Orienta Foundation, acquires the material possession of the goods requested. To exercise the right of withdrawal, the User has 14 calendar days to do so by simply communicating it to the e-mail address orienta@fundacioorienta.com.

In both cases, the communication made by the User must contain their identification data (name and surname, address, e-mail address, contact telephone number), order number, and date of purchase. The Orienta Foundation will reimburse the User for any payment received on their part within a maximum period of 14 calendar days from the date on which they have been informed of their decision to withdraw from the contract. The Orienta Foundation informs the User that, in case of withdrawal, the User will only have to bear the costs of returning the products subject to withdrawal, since the Orienta Foundation will not assume or collect these products. Once the User has communicated the desire to withdraw from the contract, the User must return to the Orienta Foundation the contracted products subject to withdrawal without undue delay and, in any case, at the latest within 14 calendar days from the date on which he/she has communicated to the Orienta Foundation the decision to withdraw.

The Orienta Foundation will reimburse the User for any payment received on their part within a maximum period of 14 calendar days from the date on which they were informed of their decision to withdraw from the contract. However, the Orienta Foundation reserves the right to withhold the reimbursement of the amounts to be returned to the User until it has received the products subject to withdrawal and once it has verified that everything is in the conditions in which they were sent.

13. Intellectual and industrial property rights

In no case and under no concept does the access to the web page or the navigation in the same imply a cession of any kind by the Orienta Foundation of the Intellectual or Industrial Property rights of the web page and its content.

Any use of the website or its contents contrary to these General Conditions of Purchase, the law, or good faith is expressly prohibited, whether or not such use has an economic purpose. The User will be responsible for any harm or damage caused to the Orienta Foundation or to third parties derived directly or indirectly from any use that the User makes of the website or its contents contrary to these General Conditions of Purchase, the law, morality, public order, or good faith. For the website and its contents to be accessible to the User, the Orienta Foundation does not require services provided by third parties. It is possible that despite the efforts made by the Orienta Foundation to keep the website available and accessible to Users, its availability may be suspended, interrupted, or cancelled for reasons beyond the control of the Orienta Foundation. In any case, any link that has the website as a destination must be directed to the website home page by clicking on the URL address of the website and covering the entire screen of the home page of the website. The Orienta Foundation is not responsible in any case or under any circumstances for the contents, information, or data related to the website, its contents, or any other matter contained in websites, platforms, forums, blogs, or other social networks that link to the website. The present General Conditions of Purchase will be in force during the time that they are exposed to the Users on the web page, in such a way that when they are modified or updated totally or partially, the present General Conditions of Purchase will cease to be in force, and the new General Conditions of Purchase will regulate the online shop of the Orienta Foundation and the actions of the Users. The Orienta Foundation informs Users that these General Conditions of Purchase may change over time. Thus, the Orienta Foundation reserves the right to modify these General Conditions of Purchase when this becomes necessary as a result of changes in the website; modifications of the Orienta Foundation in the corporate area; economic, operational, or business circumstances, or changes in the business model of the Orienta Foundation or legislative or jurisprudential novelties. In the event of a dispute, both parties submit to the resolution of conflicts to the jurisdiction that corresponds to the User according to the applicable regulations.

20. General

In no case and under the lack of exercise of its rights by the Orienta Foundation will it be understood as a waiver of these rights. The enclosures contained in these conditions are merely illustrative or informative so that they do not affect, qualify or extend the interpretation of these conditions. If any of the clauses contained in these General Conditions of Purchase are declared null and void, abusive or inapplicable, totally or partially, by a judicial or administrative body, this declaration will affect the clause in question individually, and the clause will be considered not to have been applied and the declaration of nullity, abuse or inapplicability will not extend in any way to the rest of the conditions, which will remain in force.
