m\u00e1s las consultas sobre c\u00f3mo medicar un hijo sin el consentimiento del otro progenitor. Ante todo, hay que aclarar conceptos que nos ayuden, tanto a las familias como a los profesionales a resolver estas dudas. Conviene recordar dos conceptos importantes:<\/p>\n<p style=\"text-align: justify;\"><strong>Patria potestad:<\/strong> Son los derechos y las obligaciones de los padres hacia sus hijos. En los casos de separaciones se establece por defecto la patria potestad compartida, y es muy poco frecuente que se prive a un progenitor de la patria potestad.<\/p>\n<p style=\"text-align: justify;\"><strong>Guarda y custodia:<\/strong> Son el conjunto de medidas y decisiones que toma el progenitor que tiene el menor a cargo para garantizar el desarrollo del hijo.<\/p>\n<p style=\"text-align: justify;\">Los asuntos sanitarios de los hijos pertenecen a la patria potestad, tanto en el caso de padres que viven juntos como en el caso de padres separados (casos que normalmente esta patria potestad es compartida). Por lo tanto, para tomar cualquier decisi\u00f3n sobre este aspecto, deben estar ambos padres informados sobre cualquier tratamiento, intervenci\u00f3n o consulta. Si a\u00fan as\u00ed no llegan a un acuerdo, pueden recurrir a la v\u00eda judicial. En este caso ser\u00e1 el juez quien, tras escuchar a los dos padres y al hijo (si fuera suficientemente maduro y, en todo caso, siempre que tenga m\u00e1s de 12 a\u00f1os), atribuir\u00e1 la facultad de decidir al padre o la madre.<\/p>\n<p style=\"text-align: justify;\">Por tanto, el m\u00e9dico no podr\u00e1 medicar al ni\u00f1o si no hay un acuerdo entre los dos progenitores mientras la patria potestad la tengan ambos. Un caso diferente ser\u00edan los tratamientos en caso de emergencia. Ante estas situaciones, se podr\u00eda plantear un cambio de procedimiento. El m\u00e9dico considera adecuado para mejorar su calidad de vida que tome una medicaci\u00f3n. La madre acepta y se compromete a avisar al padre. Este llama al m\u00e9dico y le dice que \u00e9l no quiere medicar a su hija, que no es partidario de dar medicaci\u00f3n.
